Repeal of Death Sentence Regulations (Section 103.45 of 7 NYCRR)

Description: Repeal regulations requiring death sentence warrants to be provided to the Commissioner and persons sentenced to death to be delivered to Clinton and Bedford Hills Correctional Facilities (death row) as a result of the New York State Court of Appeals' determination that New York's capital punishment law is not constitutional.


§ 103.45 Death sentence.

[(a)   All warrants stating a sentence of death shall be directed to the commissioner.
 (b)   All male persons sentenced to death shall be delivered to Clinton Correctional Facility (death row).
 (c)   All female persons sentenced to death shall be delivered to Bedford Hills Correctional Facility (death row).]
